01Acceptance of these terms
These Terms of Use (“Terms”) govern your access to and use of saibergard.com and its pages (the “Website”), operated by Saibergard Pte. Ltd. (UEN 202425266M), a company incorporated in Singapore with its registered office at 59G Jalan Malu-Malu, Singapore 769674 (“Saibergard”, “we”, “us” or “our”).
By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, you must not use the Website. If you use the Website on behalf of an organisation, you confirm that you are authorised to accept these Terms on its behalf.
02Information only — no advice or offer
Content on the Website is provided for general information about Saibergard and its capabilities. It does not constitute professional, legal, regulatory, technical or security advice, and you should not rely on it as such. You should obtain advice specific to your circumstances before acting on any information on the Website.
Nothing on the Website is an offer capable of acceptance, or a representation that any product or service is available in a particular jurisdiction. Any engagement with Saibergard is governed exclusively by a separate written agreement, which prevails over these Terms in the event of any inconsistency.
03Licensing
Saibergard is a Licensed Cybersecurity Service Provider (Penetration Testing) in Singapore (Licence No. CS/PTS/C-202603-080). Licensable cybersecurity services are provided only within the scope of the licence we hold and under a written agreement. References on the Website to Singapore’s standards describe the standards we hold ourselves to and do not indicate any affiliation with, or endorsement by, any government body.
04Intellectual property
The Website and its content — including text, graphics, design, layout, logos and the “Saibergard” name and shield mark — are owned by or licensed to Saibergard and are protected by intellectual property laws.
You may view the Website and print or share individual pages for your own internal, non-commercial reference, provided you do not modify them and you retain all proprietary notices. You must not otherwise copy, reproduce, republish, distribute, adapt, create derivative works from or commercially exploit any part of the Website, or use our name or marks, without our prior written consent.
Technology categories referred to on the Website are described generically. No reference implies any affiliation with, or endorsement by, any third party. Our Disclaimer forms part of these Terms.
05Acceptable use
You must use the Website lawfully and in accordance with these Terms. In particular, you must not:
- probe, scan or test the vulnerability of the Website or its infrastructure, or breach or circumvent any security or authentication measure, except as permitted under section 6;
- access, or attempt to access, any part of the Website or its systems that is not intended for public access;
- interfere with or disrupt the Website, including through denial-of-service attacks, excessive automated requests or the introduction of malicious code;
- use automated means to scrape, harvest or collect content or data from the Website, other than by search-engine crawlers that respect our robots directives;
- submit through our forms any content that is unlawful, defamatory, misleading, infringing, malicious or unsolicited commercial communication; or
- impersonate any person or organisation, or misrepresent your affiliation with any person or organisation.
Unauthorised access to computer material is an offence under the Computer Misuse Act 1993 of Singapore. We may report suspected misuse to the relevant authorities.
06Reporting security vulnerabilities
We welcome responsible disclosure. If you believe you have found a security vulnerability in the Website, please report it to security@saibergard.com, or through our contact form beginning your message with “Security report”. Our security contact details are also published at /.well-known/security.txt.
Authorised good-faith research. We authorise good-faith security research on saibergard.com that follows these rules: test only this Website; do not access, modify, download or retain data that does not belong to you beyond what is needed to demonstrate the issue; do not degrade availability (no denial-of-service, spam or social engineering of our staff); stop and report as soon as you find a vulnerability; and give us a reasonable time to fix it before any public disclosure. Research that follows these rules is authorised by us for the purposes of the Computer Misuse Act 1993, and we will not take legal action against you for it. This authorisation does not extend to third-party services or systems, and it does not override any other law.
07Information you submit
You are responsible for the information you submit to us through the Website and confirm that it is accurate and that you are entitled to provide it. Please do not submit confidential information through our contact form; any confidential discussion should take place under an appropriate written agreement. Our handling of personal data is described in our Privacy Policy.
08Third-party websites
The Website may contain links to websites operated by third parties. These links are provided for convenience only. We do not control, and are not responsible for, the content, security or privacy practices of any third-party website, and a link does not imply our endorsement.
09Disclaimer of warranties
To the fullest extent permitted by law, the Website and all content on it are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any warranties of accuracy, completeness, currency, merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Website will be uninterrupted, timely, secure or error-free.
10Limitation of liability
To the fullest extent permitted by law, Saibergard, its directors, officers, employees and agents shall not be liable for any direct, indirect, incidental, special, consequential or punitive loss or damage — including loss of profits, revenue, data, business or goodwill — arising out of or in connection with your access to, use of, or inability to use the Website, or your reliance on any content on it, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if we have been advised of the possibility of such loss.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for our obligations under applicable personal data protection laws (including the PDPA and Indonesia’s Law No. 27 of 2022), or for any other liability that cannot be excluded or limited under applicable law.
11Indemnity
You agree to indemnify and hold harmless Saibergard and its directors, officers, employees and agents from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from your material breach of these Terms or your violation of applicable law in connection with your use of the Website.
12Changes to the Website and these Terms
We may modify, suspend or discontinue any part of the Website at any time without notice. We may also update these Terms from time to time; the current version, with its effective date, is always published on this page. Your continued use of the Website after an update constitutes acceptance of the updated Terms.
13General
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce any of its terms.
14Governing law and jurisdiction
These Terms, and any dispute or claim arising out of or in connection with them or the Website, are governed by the laws of Singapore. The courts of Singapore have non-exclusive jurisdiction over any such dispute or claim. Nothing in these Terms affects any mandatory rights you have under the law of the country where you live, including Indonesian personal data protection law.
